What Changed for Sweepstakes Poker in New Mexico
Less than in most states. New Mexico hasn’t passed a sweepstakes ban, and we haven’t found any regulator or attorney general action against sweepstakes poker sites.

The Gaming Control Board says it doesn’t regulate, license or sanction any internet gambling. Some trade sites go further and report that the board treats sweepstakes casinos as illegal online gambling. We couldn’t find that statement on the board’s own site, and no enforcement has followed.
That’s why we file New Mexico under restricted rather than open. The rooms above accept New Mexico per their own terms, but the state hasn’t approved any of them.
New Mexico Online Poker Law in Plain English
New Mexico’s general gambling law, NMSA 30-19-2, makes “making a bet” a form of gambling, and gambling is a petty misdemeanor. It applies to bettors in general and doesn’t mention the internet.
No law specifically targets online poker players, and we aren’t lawyers, so we can’t say how a court would apply the older statute to online play.
The Gaming Control Board also says poker games for money outside licensed gaming are prohibited. In practice that means live poker for money happens at tribal casinos.
Can I Play PokerStars, WSOP or GGPoker in New Mexico?
No. PokerStars, WSOP Online and BetMGM Poker only run in states that license online poker, and New Mexico isn’t one of them. GGPoker doesn’t accept US players at all.
If you travel, you can play on those licensed sites while you’re physically inside a state that has them. Nevada is the closest, with WSOP Online. See our Nevada poker guide.
