What Changed for Online Poker in South Dakota
The big gambling story in South Dakota this year was online sports betting, and it went nowhere.
- February 2026. SJR 504 died on February 26 in the House. It would have asked voters in November 2026 to allow online sports betting. House State Affairs voted it down 7 to 6, and it was deferred past the last day of the session. Source, iGaming Business, February 26, 2026
- February 2026. On February 12 the Senate passed SJR 504 by 23 votes to 10. The measure covered sports betting only, not poker or casino games. Source, SBC Americas, February 12, 2026
The reason a ballot vote was needed matters for poker too. Casino games in South Dakota are limited to Deadwood and tribal casinos, and taking sports betting online needed a constitutional amendment. Online poker would likely face the same hurdle.
State law aims its felonies at people running a gambling business, under SDCL chapter 22-25A. We couldn’t find a law that targets players on online sites, and we aren’t lawyers. Offshore and sweepstakes rooms simply operate without a South Dakota license.
Can I Play PokerStars, WSOP or GGPoker in South Dakota?
No. PokerStars, WSOP Online and BetMGM Poker only run in states that license online poker, and South Dakota isn’t one of them. GGPoker doesn’t accept US players at all.
